Use of marks and logos

Upon obtaining certification for ISO 27001, NEN7510 or ISO9001, DigiTrust’s clients will receive a document containing the regulations regarding the use of the certification marks and logos they are able to use from that point onward. That document takes effect on the day the certificate is issued.

Introduction

This document describes the rules on the use of DigiTrust certification marks. Concerning the use of its certification marks, the DigiTrust principle is that certification marks instil confidence in the market that those who bear the marks also meet the relevant certification requirements. This principle and the rules described in this document also apply to any references made to DigiTrust certification, in addition to the use of the certification marks described.

Any reference to certification in a text is considered the equivalent of using a certification mark. Specific rules regarding the use of the NEN 7510 logo apply. These are included in Annex I of this document.

  1. DigiTrust certification trademarks and logos

Certification mark refers to the logo that is used by certified institutions to indicate their status as certified. The DigiTrust certification mark consists of the DigiTrust logo combined with the applicable accreditation mark of the Dutch Accreditation Council including the registration number of DigiTrust. Only organisations that hold a valid certificate issued by DigiTrust are entitled to use the DigiTrust certification mark. Organisations receive the DigiTrust logos after successful completion of the initial certification process.

  1. Use of the logos

DigiTrust certification marks may be used on:

  • correspondence;
  • advertisements and other promotional materials;
  • digital documents/media;
  • walls, doors and windows;
  • exhibition stands. Use of the certification mark in the above-mentioned situations is subject to the following general rules:
    • The complete mark must be included on every page of a document that uses the certification mark, without the institution performing any editing work on the mark.
    • The rules of this regulation also apply to the use of the certification mark on digital documents (such as on websites and other digital media).
    • DigiTrust is entitled to verify the use of the certification mark at any time. The institution shall cooperate with any such verification process.
    • If the scope of the certification is adjusted, then manifestations of the mark are also adjusted; For example:

 

Restrictions on use and unauthorised use of DigiTrust certification marks

Certified institutions shall not to give the impression that the certification applies to activities that fall outside the scope of the certification. Also, the certification may not be referred to in a manner that suggests that the certification relates to a product. Moreover, the certified organisation shall not give the impression that the organisation itself is certified.

The DigiTrust logo certification mark may not be used on:

  • product packaging;
  • cars;
  • reports or certificates that do not contain results of certified operations or statements that are not based on certified activities;
  • laboratory reports, calibration or test reports and/or certificates.

Any potentially erroneous or misleading use of the certification mark as mentioned in points 1 to 4 of Article 3 is to be avoided. This means that the activities and components that are and are not within the scope of certification must be made clear. This also means that the certified organisation shall adhere to the restrictions mentioned in Article 4. If DigiTrust finds that its certification mark is being used incorrectly or in a misleading way, it shall hold the organisation responsible and give it five (5) working days after having been given notice of the violation to take corrective measures. If after these five working days it is established by DigiTrust that the organisation is still in breach, DigiTrust will impose a fine of €250 excluding VAT on the organisation for each day the breach continues.

  1. Special instructions on the use of the certification mark

If the certification of an institution has been suspended, the institution must immediately stop using the certification mark. Upon termination of the certification, the institution must immediately:

  • Stop declaring or suggesting that it is certified;
  • Stop publishing and distributing documents bearing the certification mark or any other reference to certification.

If the organisation does not comply with this within a period of five (5) working days after the date of revocation of the certificate, DigiTrust shall impose a fine on the organisation of €250 excl. VAT for each day the violation continues.

Annex I guidelines for use of the NEN 7510 logo

Only certificate holders who, by signing an additional agreement with DigiTrust, have complied with the guidelines included in this Annex regarding the use of the NEN 7510 logo registered with the Benelux Trademark Office, may obtain the right to use the NEN 7510 logo for their services.

Use of the NEN 7510 logo by certificate holders

  • The NEN 7510 logo may only be used if the name and logo of the certificate holder are also included. The NEN 7510 logo may not be displayed more prominently than the name and logo of the certificate holder.
  • The NEN 7510 logo may not be used by the certificate holder as if it is its own manufacturer’s mark or trademark.
  • Prior written permission from NEN is required before the NEN 7510 logo may be used for other manifestations or in any other way whatsoever by the certificate holder.
  • For the right to use the NEN 7510 logo, DigiTrust B.V. provides the applicant with an NEN 7510 certificate for its services. When granting this right, DigiTrust B.V. always issues a new NEN 7510 certificate to the certificate holder.
  • The certificate holder agrees to meet the requirements that apply to the services for which the NEN 7510 certificate applies at all times during the period of validity of the certificates issued. The certificate holder shall take sufficient measures to this end. DigiTrust B.V. is entitled to acquire proof of the effectiveness of these measures and to monitor its application.
  • If an organisation loses its NEN 7510 certificate or the organisation no longer wishes to hold the NEN 7510 certificate, this organisation is prohibited from using the NEN 7510 logo in any way whatsoever. DigiTrust B.V. shall monitor this and take appropriate measures if necessary.
  • If, in the process of using the NEN 7510 logo for its services, the certificate holder ascertains or suspects that serious deviations have occurred with regard to the requirements as included in the certification scheme, the certificate holder must immediately inform DigiTrust B.V.
  • If the certificate holder wishes to make a change to the services for which the NEN 7510 certificate has been issued, it will not issue any general communications on the changed services with the NEN 7510 logo before DigiTrust B.V. has been able to assess whether the modified manifestation still meets the applicable requirements.
  • NEN is entitled to assess compliance with these instructions or have compliance assessed at any time.

Form and typographical use of an NEN 7510 logo

The NEN 7510 logo is an NEN logo. The NEN logo and word marks are registered under number 0635605 in the Benelux Trademarks Register and under number 001584127, 008822546, 008822595 and 003778099 in the Trademark Register of the European Union.

Use of the NEN 7510 logo must be in accordance with the following instructions:

  • On an NEN 7510 certificate and on other manifestations:
  • With regard to the colour of the logo, PMS 283 (light blue) and PMS 308 (dark blue) should be chosen;
  • Use of the NEN 7510 logo in black on a light background or in white on a dark background is permitted;
  • The NEN 7510 logo must be used in the layout and typographical design as prescribed and provided by NEN;
  • If necessary, the NEN 7510 logo may be enlarged or reduced in size.
  • General communications or a registered part thereof, insofar as these relate to the certified services: a. With regard to the colour of the logo, PMS 283 (light blue) and PMS 308 (dark blue) should be chosen; b. Use of the NEN 7510 logo in black on a light background or in white on a dark background is permitted; c. The NEN 7510 logo must be used in the layout and typographical design as prescribed and provided by NEN; d. If necessary, the NEN 7510 logo may be enlarged or reduced in size.
