Use of trademarks and logos

Upon obtaining certification for ISO 27001, NEN7510 or ISO9001, DigiTrust's customers will receive a document containing the regulations regarding the use of the certification marks and logos that they can start using from that moment. That document takes effect on the day the certificate is issued.

Introduction

This document describes the rules for the use of DigiTrust's certification marks. DigiTrust applies the basic premise for the use of its certification marks, that a certification mark gives the market confidence that users of the marks meet the relevant certification requirements. This premise and the rules described in this document also apply to references to a DigiTrust certification other than through the use of the certification marks described.

Referring to certifying in text is equated to using a certification mark. Specific rules on use apply to use of the NEN 7510 Image Mark. These are included in Appendix I of this document.

1. DigiTrust certification features and logos

Certification mark means the logo used by certified institutions to indicate their certified status. DigiTrust's certification mark consists of the DigiTrust logo combined with the applicable accreditation mark of the Dutch Accreditation Council, containing DigiTrust's registration number. Only organisations holding a valid certificate issued by DigiTrust are entitled to use DigiTrust's certification mark. An organisation receives the DigiTrust logos after successful completion of the initial certification process.

2. Use of logos

DigiTrust's certification seals may be used on:

  • correspondence;
  • advertisements and other promotional material;
  • digital documents/media;
  • walls, doors and windows;
  • exhibition stands.

 

The use of the certification mark on the above items is subject to the following general rules:

    1. Every page of a document on which the certification mark is used should include the complete mark without having been edited by the institution.
    2. The use of the certification mark on digital documents (such as on websites and other digital media) is also subject to the rules set out in this regulation.
    3. DigiTrust is entitled to verify the use of the certification mark at any time. The institution shall cooperate with such verifications.
    4. If the scope of certification is changed, the expressions will be adjusted.

 

3. Restrictions on use and unauthorised use of certification marks DigiTrust

Certified bodies must not give the impression that the certification applies to activities outside the scope of the certification. Also, the certification may not be referred to in a way that suggests that the certification relates to a product. Moreover, the certified organisation will not give the impression that the organisation itself is certified.

DigiTrust's logo certification mark may not be used on:

      • product packaging;
      • cars;
      • reports or certificates not containing results of certified operations or on statements not based on certified activities;
      • laboratory reports, calibration or inspection reports and/or certificates.

Any potentially incorrect or misleading use of the certification mark mentioned in points 1 to 4 of Article 3 must be avoided. This means that it must be made clear which activities are and which are not part of the scope of certification. If DigiTrust observes that its certification mark is being used incorrectly or misleadingly, it shall call the organisation to account and give it five (5) working days to take corrective action after observing the violation. If, after these five working days, DigiTrust finds that the organisation is still in breach, DigiTrust shall impose a fine of €250 excluding VAT on the organisation for each day that the breach continues.

4. Details on the use of the certification mark

If an institution's certification is suspended, the institution should immediately stop using the certification mark. Upon termination of certification, the institution should immediately:

      1. To stop proclaiming or suggesting that she is certified;
      2. To stop publishing and distributing documents with the certification mark or any other reference to certification.

If the organisation does not comply with this within a period of five (5) working days after the certificate's revocation date, DigiTrust will impose a fine of € 250, - excluding VAT, on the organisation for each day that the breach continues.

Appendix I Guidelines for use of NEN 7510 logo

Only certificate holders who, by signing an additional agreement with DigiTrust B.V., have conformed to the guidelines included in this appendix concerning the use of the NEN 7510 logo registered with the Benelux Trademark Office, can obtain the right to use the NEN 7510 logo for their services.

Use of the NEN 7510 logo by certificate holder

      • The NEN 7510 Image Mark may only be used if the name and logo of the certificate holder are also used. The NEN 7510 Image Mark may not be more striking than the name and logo of the certificate holder.
      • The NEN 7510 logo may not be used by the certificate holder as its own manufacturer's or trademark.
      • Only after written permission from NEN can the NEN 7510 logo be used by the certificate holder for other expressions or in other ways.
      • For the right to use the NEN 7510 logo, DigiTrust B.V. provides the applicant with a NEN 7510 certificate for his services. Upon granting this right, DigiTrust B.V. shall issue a new NEN 7510 certificate to the certificate holder each time.
      • During the period of validity of the certificates issued, the certificate holder undertakes to always comply with the requirements applicable to the services to which the NEN 7510 certificate applies. The certificate holder shall take sufficient measures to this end. DigiTrust B.V. is entitled to convince itself of the effectiveness of these measures and to check their application.
      • If an organisation loses its NEN 7510 certificate or the organisation no longer wishes to have the NEN 7510 certificate, this organisation is prohibited from using the NEN 7510 logo in any way with immediate effect. DigiTrust B.V. monitors this and takes appropriate measures if necessary.
      • If the certificate holder carries the NEN 7510 Image Mark for his services while it can be established or suspected that serious deviations have occurred from the requirements laid down in the certification scheme, he shall immediately inform DigiTrust B.V. of this.
      • If the certificate holder wishes to make a change to his services for which the NEN 7510 certificate has been issued, he shall not provide general announcements about the changed services with the NEN 7510 logo before DigiTrust B.V. has been able to assess whether the changed implementation still meets the applicable requirements.
      • NEN is at all times entitled to check compliance with these instructions (or have them checked).

Form and typographical execution of a NEN 7510 logotype

The NEN 7510 figurative mark is a figurative mark of NEN. NEN figurative and word marks are registered under number 0635605 in the Benelux Trademark Register and under number 001584127, 008822546, 008822595 and 003778099 in the European Union Trademark Register.

Use of the NEN 7510 Image Mark must be made in accordance with the following instructions:

      1. On a NEN 7510 certificate and on other expressions:
        1. Regarding the colour of the logo features, PMS 283 (light blue) and PMS 308 (dark blue) should be chosen;
        2. Use of the NEN 7510 logo in black on a light background or in white on a dark background is permitted;
        3. The NEN 7510 logo must be used in the layout and typographical execution as prescribed and provided by NEN;
        4. If necessary, the NEN 7510 logo may be enlarged or reduced in size.
      2. On general expressions or the registered part thereof, insofar as these relate to the certified service provision: a. PMS 283 (light blue) and PMS 308 (dark blue) must be chosen for the colour of the logo features; b. Use of the NEN 7510 Image Symbol in black on a light background or in white on a dark background is permitted; c. The NEN 7510 Image Symbol must be used in the layout and typographical implementation as prescribed and provided by NEN; d. If necessary, the NEN 7510 Image Symbol may be enlarged or reduced.
